Several federal and state laws provide whistleblower incentives and protections. Whistleblowers who report fraud against the government under these laws can receive monetary awards. Whistleblowers who report their employers are protected from retaliation such as being fired or demoted. Whistleblower lawsuits are also known as “qui tam” lawsuits. The whistleblower claims attorneys of Hastings, Cohan, and Walsh, LLP, can help you receive the maximum reward for your efforts while enjoying the full protection of the law.

Whistleblower Incentives

The majority of whistleblower claims fall under the False Claims Act which entitles whistleblowers, also called relators, to an award of 15% to 30% of the recovery.

Violations of securities law, commodities law, and the Foreign Corrupt Practices Act (FCPA) are covered by the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank) which entitles whistleblowers to 10% to 30% of recovery that is in excess of $1 million.

The Tax Relief and Health Care Act of 2006 entitles IRS tax fraud and evasion whistleblowers to 15% to 30% of the recovery.

Whistleblower Protections

Anyone who is aware of fraud against the government can file a qui tam lawsuit. This includes employees, customers, consultants, and competitors. Employees take on a considerable risk when they become whistleblowers. To reduce this risk and encourage employees to report their employers, whistleblower laws provide protection from retaliation such as being fired, demoted, or harassed.

Employees can receive compensation for retaliation including reinstatement, back pay with interest, and more.
